At Brand Armour®, we take our business seriously, and that includes how we present ourselves. You may have noticed our new logo making its debut over the past week or two in our email signature boxes.

Our new logo, and soon-to-be-launched website, reflect our professionalism, dedication, and practical approach to protecting our clients’ trademarks.

Now, let us share how we’re protecting our new logo:

Copyright Protection

First, we ensured that the graphic designer who assisted with the logo assigned all rights in and to the logo to us in writing.

The logo qualifies as an artistic work under the Copyright Act No. 98 of 1978, and is thus eligible for copyright protection. Since the designer is a co-author, she initially owned an undivided half-share in the work. However, because copyright assignments must be in writing to be valid, we obtained a written assignment, giving us full ownership of the logo.

Pro tip: Paying a designer and giving instructions isn’t enough, a written assignment is essential to secure ownership under copyright law.

 Trademark Protection

“BRAND ARMOUR” is already registered as a word mark, but that only protects the wording in plain block letters, not stylised versions or variations. To ensure comprehensive protection (what we call the “Rolls-Royce®” treatment), we filed trademark applications for:

  • “BRANDARMOUR” (combined word) in block letters, in black and white;
  • “BRANDARMOUR” in the logo’s custom font, with “BRAND” in grey and “ARMOUR” in black;
  • The same combined word in FULL COLOUR, specifying the exact Pantone® codes; and
  • The combined word together with the tagline: “Safeguard your business”, in black and white.

At that point, we were confident we’d secured the best protection money can buy, and it was time to get back to protecting our clients’ trademarks 😊.
